ON MEASURES IN THE EVENT OF STATE OF EMERGENCY

Article 1

The President of the Republic, at the proposal of the Government, declares a state of emergency and passes acts for the purpose of taking measures to eliminate such state, in accordance with the Constitution and law.

Article 2

It shall be understood that conditions are met to have a state of emergency declared in a part of the territory of the Republic of Serbia when actions are taken threatening the constitutional order, security of the Republic - its sovereignty, independence and territorial integrity, economic and social activities, exercising and protection of freedoms, rights and duties of man and the citizen and functioning of state bodies.

A state of emergency may also be declared in the event of natural disasters and other widespread threats for the lives of citizens.

Article 3

The proposal by Government to declare a state of emergency shall contain an assessment of the threat pursuant to Article 2 of the present Law, the resulting or possible consequences and how to eliminate the state of emergency.

The Government proposal shall also include the draft act on measures to eliminate the state of emergency.

The Government shall simultaneously submit the proposal to the National Assembly speaker.

Article 4

After accepting the proposal of the Government, the President of the Republic shall make a decision on declaring a state of emergency.

The decision referred to in paragraph 1 of the present Article shall determine the area of the Republic of Serbia to which the state of emergency shall apply.

The decision on declaring a state of emergency shall be published in accordance with law and simultaneously submitted to the National Assembly and the Government.

The National Assembly shall convene without being called after the President of the Republic has declared a state of emergency.

Article 5

The President of the Republic shall pass decrees and other acts to take measures to eliminate the state of emergency, in accordance with the Constitution and law.

The acts specified in paragraph 1 of the present Article shall provide for measures in accordance with law, depending on circumstances and reasons leading to the state of emergency, and with the proviso that their implementation ensure elimination of the state of emergency in the shortest possible time, and that they involve least possible detrimental effects.

Article 6

By the acts specified in Article 5 of the present Law, the President of the Republic may: set out mandatory work duty, restrict freedom of movement and residence, restrict the right to strike, freedom of assembly, freedom of political, trade union and other activity.

The President of the Republic may order other measures as well, in accordance with law.

The National Assembly shall regulate the manner of exercising certain freedoms and rights of citizens in the state of emergency.

Article 7

Acts specified in paragraph 5 of the present Law shall be published in accordance with law and referred to the National Assembly speaker and the Prime Minister.

Article 8

The rights and duties exercised by the presidencies of the republics in the event of established emergency circumstances and/or state of emergency, declared in accordance with the Constitution of the SFRY and the federal regulations shall be exercised in the Republic of Serbia by the President of the Republic.

Article 9

Citizens and their organisations, enterprises, institutions and other organisations, government and other bodies, on the territory under the state of emergency, are required to take measures, for the duration of the state of emergency, within the scope of their rights and duties and/or competence in accordance with orders and other acts of the President of the Republic, other competent bodies as well as current circumstances.

Article 10

Once the circumstances leading to declaring of the state of emergency have ceased, the President of the Republic, at his/her own initiative or at the proposal of the Government, shall take a decision declaring end of the state of emergency and shall accordingly inform the National Assembly and the Government.

Enacting of the decision ending the state of emergency shall also abrogate the orders and other acts passed for the purpose of undertaking ordered measures.

Specific orders and other acts specified in paragraph 1 of the present Article may be abrogated by the President even prior to the enactment of the decision on declaring the end the state of emergency.

Article 11

On the part of the territory of the Republic of Serbia where special circumstances were declared prior to coming into force of the present Law, measures set out by special regulations shall apply, and other measures may be introduced as determined by the National Assembly.

Measures specified in paragraph 1 of the present Article shall apply until such time as the National Assembly decides otherwise.

Article 12

The present Law shall enter into force on the eighth day following its publication in the "Official Herald of the Republic of Serbia".
