MEMORANDUMBETWEEN THE MINISTRY OF INTERNAL AFFAIRS OF THE REPUBLIC OF SERBIA AND THE FEDERAL SERVICE OF THE RUSSIAN FEDERATION FOR NARCOTICS TRAFFIC CONTROL ON COOPERATION IN COMBATING NEW PSYCHOACTIVE SUBSTANCES("Off. Herald of RS - Treaties", No. 21/2015) |
The Ministry of Internal Affairs of the Republic of Serbia and the Federal Service of the Russian Federation for Narcotics Traffic Control, hereinafter referred to as the Participants,
being conscious that the spread and the abuse of new psychoactive substances have posed a threat to public health of the Participants’ States,
taking into consideration the Report of the International Narcotics Control Board for 2012 that emphasizes the problems emerging in the result of the abuse of new psychoactive substances,
emphasizing the need of elaboration of comprehensive and complex approaches for detection, analysis and identification of new psychoactive substances,
considering the rapid growth of new psychoactive substances and the role of Internet in sale and promotion of these substances,
reaffirming the need of sustained monitoring and mutual use of information on new psychoactive substances,
drawing special attention to the possibility of harmful consequences of the abuse of new psychoactive substances for the health of individuals and whole society,
in the framework of the realization of Agreement between the Ministry of Internal Affairs of the Republic of Serbia and the Federal Service of the Russian Federation for Narcotics Traffic Control on cooperation in combating illicit traffic of narcotic drugs, psychotropic substances and their precursors of 22 August 2011 (hereinafter referred to as the Agreement),
considering mutual interest to take effective measures on combating new psychoactive substances, including combating their production and spread as well as their abuse (hereinafter referred to as combating new psychoactive substances),
have agreed on the following issues:
1. This Memorandum will use the term ‘new psychoactive substances’ to describe the substances of abuse, either in a pure form or in a preparation that are neither controlled by the 1961 Single Convention on Narcotic Drugs nor by the 1971 Convention on Psychotropic Substances, but which may pose a public health threat.
2. This Memorandum is aimed to organize and develop cooperation between the Participants in combating new psychoactive substances in an effective way.
3. The Participants will cooperate in combating new psychoactive substances within their competence on the grounds of this Memorandum and in accordance with their national law and international obligations of their States as well as in compliance with the provisions of the Agreement.
4. The cooperation between the Participants in combating new psychoactive substances will be realized in the following forms:
a) exchange of information on the issues of combating new psychoactive substances;
b) exchange of advanced methods and experience in combating new psychoactive substances, including experience in taking effective measures on the national and regional levels to solve the problems caused by new psychoactive substances as well as experience in the strategy of new psychoactive substances detection;
с) elaboration of common strategy of prevention of the abuse of new psychoactive substances as well as common measures on combating new psychoactive substances, including the measures of rapid and effective detection of new psychoactive substances;
d) exchange of legislative and other national legal acts of their States, materials on practices of their execution, statistic data and methodical recommendations on matters of combating new psychoactive substances;
e) advisory assistance as well as expertise assistance of new psychoactive substances;
f) carrying out common scientific research of mutual interest on the issues of production and spread of new psychoactive substances as well as their abuse;
g) exchange of new psychoactive substances samples and their test results, if needed.
5. Exchange of information on the issues of combating new psychoactive substances will be realized in respect to:
a) detected and identified new psychoactive substances, including information on their characteristics;
b) harmful effect on health caused by the abuse of new psychoactive substances;
c) forms and methods used to monitor the emergence of new psychoactive substances;
d) methods used for production and spread of new psychoactive substances, including information on the routes of deliveries and the use of Internet for assistance of such activities;
e) places of illegal production and spread of new psychoactive substances in case of the existence of such places;
f) individuals suspected of production and spread of new psychoactive substances;
g) current situation in the Participants’ States concerning the abuse of new psychoactive substances;
h) quantity of new psychoactive substances seized from illegal traffic in case of existence of such traffic;
i) measures of the state control established in respect of detected new psychoactive substances, including temporary measures;
j) practices of taking measures on the reduction of supply on new psychoactive substances and on the treatment of individuals taking new psychoactive substances, including the measures taken on the legislative level;
k) forms of use and characteristic features of individuals taking new psychoactive substances;
l) other issues related to combating new psychoactive substances.
6. Cooperation between the Participants in combating new psychoactive substances will be realized in accordance with the procedure defined by the Agreement.
7. To solve the problems caused by new psychoactive substances the Participants will hold joint work meetings, consultations and workshops.
8. This Protocol applies from the date of its signature.
9. This Memorandum is not an international treaty and it does not generate rights and obligations regulated by international law for the Participants.
DONE in Moscow on 27th October 2015., in two copies, each in the Serbian, the Russian and the English languages. In case of any divergence of interpretation, the English text shall prevail.
