AGREEMENT
BETWEEN GOVERNMENT OF THE REPUBLIC OF SERBIA AND GOVERNMENT OF THE STATE OF KUWAIT ON DONATION OF STATE OF KUWAIT TO REPUBLIC OF SERBIA FOR REHABILITATION FROM THE DEVASTATING FLOODS THAT AFFECTED THE REPUBLIC OF SERBIA IN MAY 2014

The Ministry of Foreign Affairs of the Republic of Serbia presents its compliments to the Embassy of the State of Kuwait in Belgrade and, with reference to the Embassy’s Note No. AMB-VN-M-119 of 5 June 2014, informing the Prime Minister of the Republic of Serbia that the Government of the State of Kuwait has decided to donate the aid in the amount of up to one million US dollars to the Government of the Republic of Serbia for rehabilitation from the devastating floods that affected the Country in May 2014, and with reference to the consultations held between the representatives of the Flood Affected Areas Assistance and Rehabilitation Office of the Government of the Republic of Serbia and the Embassy of the State of Kuwait in Belgrade, has the honour to propose, on behalf of the Government of the Republic of Serbia, the following understanding:

1. The Government of the State of Kuwait shall donate to the Government of the Republic of Serbia assistance of up to one million US dollars, inclusive of related costs and charges of administering the aid by the representatives of the State of Kuwait, for rehabilitation from floods, in a manner jointly agreed in consultations between the representatives of both sides.

2. The Government of the Republic of Serbia shall ensure that the aid granted by the Government of the State of Kuwait shall be used properly and exclusively to rehabilitate the flood-affected areas and to assist the population in the said areas.

3. It is jointly agreed by the representatives of the Government of the State of Kuwait and the Government of the Republic of Serbia that the first part of the aid shall comprise a donation of 25 prefabricated houses to be built in the total value of EUR 400 000, with the representatives of the Embassy of the State of Kuwait and the Kuwait Red Crescent Society directly negotiating and executing the payment to the building contractor.

4. It is jointly agreed by the representatives of the Government of the State of Kuwait and the Government of the Republic of Serbia that the second part of the aid in the total value of EUR 229 000 shall be used for rebuilding of two bridges in the Municipality of Krupanj (on River Likodra and on River Bogostica), and that the representatives of the Embassy of the State of Kuwait and the Kuwait Red Crescent Society will execute the payment of donation funds for the said works through the Flood Affected Areas Assistance and Rehabilitation Office of the Government of the Republic of Serbia.

5. Further procedural details regarding the implementation of the present understanding shall be agreed upon in direct consultations between the relevant representatives of the two Governments.

6. The goods and services, and the import of goods which shall be financed by the aforesaid donation, shall be exempt from VAT and customs duty.

7. This Note and the Note in reply from the Embassy of the State of Kuwait in Belgrade shall constitute an agreement on donation between the two Governments, which shall enter into force on the date of the Embassy’s Note in reply.

The Ministry of Foreign Affairs of the Republic of Serbia avails itself of this opportunity to renew to the Embassy of the State of Kuwait in Belgrade the assurances of its highest consideration.

Verbal Note

The Embassy of the State of Kuwait in Belgrade presents its compliments to the Ministry of Foreign Affairs of the Republic of Serbia and has the honour to acknowledge the receipt of the latter’s note No. 946 dated January 13, 2016, which reads as follows:

The Embassy of the State of Kuwait in Belgrade has the honour to confirm the acceptance of the foregoing proposal and to confirm that the Note by the Ministry of Foreign Affairs of the Republic of Serbia and the Embassy’s Note in reply shall constitute an agreement on donation between the two Governments, which shall enter info force on the date of this Note in reply.

The Embassy of the State of Kuwait in Belgrade avails itself of this opportunity to renew to the Ministry of Foreign Affairs of the Republic of Serbia the assurances of its highest consideration.
