MEMORANDUM
OF UNDERSTANDING BETWEEN THE MINISTRY OF PUBLIC ADMINISTRATION AND LOCAL SELF-GOVERNMENT OF THE REPUBLIC OF SERBIA AND THE MINISTRY OF THE INTERIOR OF THE REPUBLIC OF KOREA ON COOPERATION IN THE AREA OF E-GOVERNMENT

The Ministry of Public Administration and Local Self-Government of the Republic of Serbia and the Ministry of the Interior of the Republic of Korea (hereinafter individually referred to as "the Side" and collectively as "the Sides"),

CONSIDERING the importance of e-Government, which serves to increase competitiveness and promote economic development of the two countries,

RESPECTING the principles of equality and mutual benefit,

WISHING to deepen and develop cooperation in the administrative modernization through high-level contacts, with a view to promoting cooperation between the Sides in the area of e-Government,

CONVINCED that such cooperation will help simplify regulations and procedures and thereby ensure that the interaction between the two countries and their citizens will be transparent, secure and high-quality,

HAVE reached the following understanding:

Paragraph 1

OBJECTIVE

The objective of this Memorandum of Understanding (hereinafter referred to as the "MoU") is to promote cooperation and exchange of experiences in the area of e-Government, in accordance with national laws and regulations of each Side, as well as international law.

Paragraph 2

SCOPE OF COOPERATION

Cooperation in the area of e-Government under this MoU will include:

a) e-Government related capacity building activities such as sharing best practices, implementing personnel exchanges and conducting joint studies;

b) e-Government related corporate cooperation activities;

c) policy consultation and technical assistance in developing e-Government, in creating and amending related laws, and establishing related institutions;

d) establishment of an e-Government Cooperative Committee to facilitate the implementation of cooperative activities under this MoU; and

e) any other form of cooperation that may be jointly decided upon by the Sides.

Paragraph 3

FUNDING

In principle, each Side will bear the costs of its own cooperative activities under this MoU, in accordance with national laws and regulations and subject to availability of resources, unless otherwise jointly decided by the Sides.

Paragraph 4

CONFIDENTIALITY

Any information produced as the result of the cooperative activities under this MoU will be used exclusively by the Sides. Such information may only be released to third parties by mutual written consent of the Sides.

Paragraph 5

SETTLEMENT OF DISPUTE

Any difference arising from the interpretation or implementation of this MoU will be settled amicably through consultations and negotiations between the Sides without reference to any third party or international tribunal.

Paragraph 6

AMENDMENT

This MoU may be reviewed or amended at any time by mutual written consent of the Sides. Any amendment will come into effect on such date as may be jointly determined by the Sides and will form an integral part of this MoU.

Paragraph 7

ENTRY INTO EFFECT, DURATION AND TERMINATION

1. This MoU is not intended to create any legal obligation under international law.

2. This MoU will come into effect on the date of signature and will continue to have effect for a period of five (5) years unless terminated by either Side giving three (3) months written notice to the other. The expiration or termination of this MoU will not affect the validity or duration of any ongoing programs and activities made under this MoU, unless otherwise jointly decided by the Sides.

3. This MoU may be renewed, on condition that the Sides have made substantial progress under this MoU. The Sides will decide terms and conditions for renewal through a meeting or written correspondence.

Signed in duplicate at Seoul, Republic of Korea, on 16th day of March 2016, in the Serbian, Korean, and English language, each text being equally authentic. In case of divergence of interpretation, the English text shall prevail.
