MEMORANDUM OF UNDERSTANDING (MoU)
ON STRENGTHENING THE DEVELOPMENT OF INFORMATION SILK ROAD FOR INFORMATION CONNECTIVITY BETWEEN MINISTRY OF TRADE, TOURISM AND TELECOMMUNICATIONS OF THE REPUBLIC OF SERBIA AND NATIONAL DEVELOPMENT AND REFORM COMMISSION (NDRC) OF THE PEOPLEā€˜S REPUBLIC OF CHINA

Ministry of Trade, Tourism and Telecommunications of the Republic of Serbia and National Development and Reform Commission (NDRC) of the People‘s Republic of China, (hereinafter referred to as the "Parties").

RECOGNIZING the importance of science and technology, and in particular information communication technology (ICT) applications, for the prosperity and development of national economy,

RESPECTING the principles of equality and mutual benefit,

WISHING to deepen and develop cooperation between the parties in the area of the ICT applications through high-level contacts,

CONSIDERING the challenges and opportunities involved in a rapidly changing ICT environment, including the accelerated evolution of digital convergence.

HAVE reached the following understanding:

Article I

The purpose of this Memorandum of Understanding (hereinafter referred to as the "MoU") is to promote cooperation and the exchange of experiences in the area of ICT applications, and jointly push forward the development of Information Silk Road to realize mutual benefits.

Article II

Cooperation between both parties in ICT applications under this MoU will include, but not be limited to, the following areas:

1) Promote the cooperation in fields of smart cities, telemedicine, and Internet Plus.

2) Promote the cooperation in fields related to ICT, such as Internet network (broadband), satellite service, new industries including cloud computing, etc.

3) Promote the establishment of the Information Silk Road Economic Cooperation Trial Zone between Serbia and China; mutually designate cooperative city pairs and support the cooperation in areas such as e-commerce platform construction, information service and technological exchanges, etc.; facilitate logistics and trade information connectivity, and strengthen industrial exchanges of the Parties.

4) Any other fields of cooperation that may be jointly decided upon by the Parties under this MoU.

Article III

The implementation of this bilateral cooperation will be carried out through the following mechanisms:

1) Support cooperation among related organizations e.g., universities and private sector in the field of ICT, etc.

2) Support exchanges and cooperation among high-tech, logistics, and e-commerce enterprises.

3) In order to effectively implement the MoU, Parties share the view that Ministry of Trade, Tourism and Telecommunications and of the Republic of Serbia, and Department of High-Tech Industry, National Development and Reform Commission (NDRC) of the People‘s Republic of China are well suited to take the leading role in organizing working teams, coordinating and facilitating the implementation the cooperation activities provided in this MoU.

4) The Parties agree to regard the relevant institution of Serbian side and International Economic Cooperation Office of Macroeconomic Research (IECO, AMR) of Chinese side for coordination and implementation with respect to items of relevance to this MoU.

5) Provisions of this MoU shall be effectively executed in compliance with the legislations in force in each country, and according to the principle of reciprocity and intellectual property rights duly recognized under international conventions in which both countries are joining parties.

6) Activities in association with this MOU will be carried out depending on the resources available to each Party.

Article IV

This MoU shall enter into force on the date of mutual signature.

Provisions of this MoU may be revised under writing agreement by both Parties in accordance with the rules in force in both countries.

This MoU shall remain valid for five years from the date it takes effect. It will be automatically renewed for similar term(s) unless either party issues a termination or non-renewal notice in writing at least six months before expiration of the MoU.

The Parties share the understanding that the information provided by one Participant to the other are intended solely for internal use and it is not their aim to disclose the information to third parties without prior consent of the information provider.

Any dispute that may arise between the Parties with respect to interpretation or/and implementation of this MoU, shall be amicably resolved through deliberations and negotiations without resorting to any local or international tribunal and/or third party for resolution.

Termination of this MoU shall not impair the completion of any cooperation programs effectively undertaken before such a termination unless both Parties agree otherwise.

Signed in Belgrade on 18th of June 2016 in two original copies in Serbian, Chinese, and English language, three texts are equally authentic, however in case of diversion the English text will prevail.
