MEMORANDUM
OF UNDERSTANDING BETWEEN THE MINISTRY OF AGRICULTURE, FORESTRY AND WATER MANAGEMENT OF THE REPUBLIC OF SERBIA AND MINISTRY OF AGRICULTURE AND RURAL AFFAIRS OF THE PEOPLE’S REPUBLIC OF CHINA, WITH RESPECT TO THE JOINT SUPPORT FOR THE BUILDING OF FRUIT & VEGETABLE INDUSTRIAL PARK

RECITALS

Whereas, the Government of the Republic of Serbia and the People’s Republic of China signed on 26th of November 2015 the Memorandum of Understanding on jointly promoting the silk road economic belt and 21st century maritime silk road initiative;

Whereas, the Ministry of Agriculture and Environmental Protection of the Republic of Serbia and the Ministry of Agriculture of the People’s Republic of China signed on 17th of January 2017 the Memorandum of Understanding on cooperation in the field of agriculture;

Whereas, taking into account positive results of the bilateral cooperation between the Republic of Serbia and the People’s Republic of China;

Per this Memorandum of Understanding (hereinafter "MOU"), the Ministry of Agriculture, Forestry and Water Management of the Republic of Serbia and the Ministry of Agriculture and Rural Affairs of the People’s Republic of China agree as follows:

Article 1

The Ministry of Agriculture, Forestry and Water Management the Republic of Serbia, and the Ministry of Agriculture and Rural Affairs of the People’s Republic of China (hereinafter "The Parties"), within their respective areas of competence and in line with the laws of the respective countries, observing the principles of equality, mutual benefits and win-win cooperation, shall support the development of the industrial park with a view to deepening bilateral investment and cooperation in the field of agriculture.

The Parties, shall jointly push forward the development of the industrial park, take advantages of the convenient transportation and infrastructure of the Hungary-Serbia Railway, do their best to give a full play to the industrial park in integrating the strengths of industries, capitals, technologies, policies and brands, and raise the level and quality of bilateral agricultural cooperation in all respects.

Article 2

The Parties shall give maximum efforts to make the industrial park an agricultural cooperation platform and a project model highlighting a synergic development of BIR infrastructure construction and cooperation in the field of agriculture.

The industrial park shall follow the market principles and will be focused on engagement of companies that have the latest agricultural technologies. The Parties shall give maximum efforts to include best rated companies in the construction and development of the industrial park, which shall be a guarantee for the successful work and development. The two Parties shall support the development of the industrial park by giving their guidelines, suggestions and coordinate their joint activities. 

Article 3

The Parties shall review and in accordance with their laws suggest and provide the most effective support measures which shall facilitate the construction and development of the industrial park.

Specific and concrete policies and measures shall be discussed later, which shall be subject of additional agreements, action plans and other documents and enable the successful implementation of these projects.

Article 4

Each Party to this MOU intends to keep strictly confidential the information received from the other Party, if such information is deemed confidential in terms of the rules and regulations, or if they are deemed confidential in accordance with the national law of any of the Parties.

Information in Paragraph 1 of this Article is not intended to be shared with a third party without the written consent of the Party that provided it.

The Parties could, exceptionally, disclose the information from the Paragraph 1 of this Article merely for the purpose of litigation or at the request of other bodies, in accordance with the national law of any of the Parties.

The Parties agree that all the realized activities, as stipulated by this MOU, will be carried out in accordance with the laws and regulations of both countries.

Article 5

For the purpose of tracking and evaluation of activities and cooperation as specified in this MOU, the Parties shall set up a Joint Coordinating Committee, whereby the Committee shall have three members from each of the Parties.

The Joint Coordinating Committee shall be obliged to inform both Parties on the realized activities every 6 (six) months after the MOU comes into operation.

Article 6

Each Party shall bear its own costs incurred in relation to this MOU and no Party shall have any claims towards the other Party, regarding the costs incurred in relation to this MOU. 

Article 7

Disputes as to the interpretation or application of the provisions of the MOU, are to be settled through consultations and negotiations between the Parties.

Article 8

This MOU can be modified only with the written consent of both Parties. Each Party has the right to unilaterally terminate the MOU and inform the other Party, with a 3 (three) month notice.

Article 9

This MOU shall come into operation on the date of signing and is valid for five (5) years. If one of the Party fails to notify the other Party of the termination of this MOU in writing through diplomatic channels not less than 6 months prior to itse expiration, this MOU shall be automatically extended for another five years. The termination of this MOU shall not affect the project that has already been implemented and that shall be continued until its completion as scheduled.

Prepared in Sofia on July 7th 2018, in two originals in the Serbian, Chinese and English languages, whereas each text is deemed equally authentic. In the case of any divergence of interpretation, the English version shall prevail.
