MEMORANDUM

OF UNDERSTANDING BETWEEN THE MINISTRY OF FOREIGN AFFAIRS OF THE REPUBLIC OF SERBIA AND THE MINISTRY OF FOREIGN AFFAIRS OF THE REPUBLIC OF CYPRUS ON COOPERATION AND BILATERAL POLITICAL CONSULTATIONS

("Off. Herald of RS - Treaties", No. 1/2019)

The Ministry of Foreign Affairs of the Republic of Serbia and the Ministry of Foreign Affairs of the Republic of Cyprus (hereinafter referred to individually as "the Participant" and collectively as the "Participants"),

DESIROUS to further develop and strengthen the traditional relations of friendship and cooperation and mutual understanding between the two States;

RECOGNISING the benefits of holding regular consultations and cooperating at various levels of bilateral relations and on international issues of common concern;

REAFFIRMING their adherence to the fundamental principles of international law and the Charter of the United Nations;

Have reached the following understanding:

Paragraph I

Talks and consultations

The Participants will hold bilateral political consultations in order to:

a) discuss all aspects of their bilateral relations and the promotion of contacts between their people in order to promote the relations between the States,

b) exchange views on regional and international issues of common concern, and

c) strengthen the positive role of the United Nations, the Organization for Security and Co-operation in Europe (OSCE) and other international organisations in resolving disputes and problems facing the international community.

Paragraph II

Consultation mechanism

The Participants will hold consultations on a rotational basis in both States and/or on the sidelines of international organisations’ high level meetings and/or international conferences, at senior officials’ level and/or between the Ministers of Foreign Affairs. The agenda and dates of consultations will be jointly decided between the Participants through diplomatic channels.

Paragraph III

Constructive cooperation

The representatives of both Participants at international conferences and meetings, including the United Nations high level meetings, will hold consultations on agenda items of mutual interest. Furthermore, the Participants, where and when possible, will create favourable conditions for the establishment of direct contacts and exchange of experience for their diplomats through the exchange of training and special courses in the field of international relations, international economics and international law organised by institutions of both States.

Paragraph IV

Date and agenda of consultations

The date and agenda of the consultations will be jointly decided by the Participants through diplomatic channels.

Paragraph V

Amendment

This Memorandum of Understanding may be amended, at any time, by the mutual written consent of the Participants through diplomatic channels. The amendments will be formalized in writing and form an integral part of this Memorandum of Understanding, and include the date on which they will come into effect. Any amendment will not affect any of the commitments and/or benefits arising from this Memorandum of Understanding before the coming into effect of the amendment, unless the Participants decide otherwise, in writing, through diplomatic channels.

Paragraph VI

Settlement of disputes

Any dispute regarding the interpretation, application and/or implementation of this Memorandum of Understanding will be settled amicably through consultations between the Participants and will not be referred to any national or international tribunal or third party for settlement.

Paragraph VII

Effective date, duration and termination

This Memorandum of Understanding:

(a) will come into effect on the date of its signature,

(b) will remain in effect for a period of five years, and will be automatically extended for successive five-year periods, unless terminated by either Participant in accordance with paragraph (c) below,

(c) may be terminated, at any time, by either Participant by notifying the other Participant, in writing, through diplomatic channels, of its intention to terminate it. The termination will become effective three (3) months after the date of receipt of the written notification by the other Participant, or on such later date as may be specified in the notification. The termination of this Memorandum of Understanding will not affect the implementation of the talks and consultations that both Participants have decided upon prior to the termination of this Memorandum of Understanding.

The foregoing represents the understanding reached between the Participants on the matters referred to herein.
