COOPERATION AGREEMENTBETWEEN THE MINISTRY OF AGRICULTURE, FORESTRY AND WATER MANAGEMENT OF THE REPUBLIC OF SERBIA AND THE JAPAN AND SOUTHEAST-EUROPE BUSINESS ASSOCIATION("Off. Herald of RS - Treaties", No. 2/2019) |
Based on the Agreement on Technical Cooperation between Council of Ministers of the Serbia and Montenegro and Government of Japan (signed on November 30, 2005)
The Ministry of Agriculture, Forestry and Water Management of the Republic of Serbia, Belgrade, Nemanjina 22-26, hereafter referred as "Ministry", represented by, Mr. Branislav Nedimović, Minister and
the Japan and Southeast-Europe Business Association, Tokyo 1-6-8 Shintomi, Chuo-ku, 104-0041 Japan, hereinafter referred as the "JSEEBA", represented by Kihachiro Nishiura, president of JSEEBA, hereinafter referred as ˮPartiesˮ,
Bearing in mind general approach toward agriculture, forestry and water management development in the Republic of Serbia,
have agreed as follows:
I GENERAL TERMS AND CONDITIONS
Article 1
The Parties hereby declare their mutual intention for a long-term cooperation and partnership in the fields of agriculture, forestry and water management and promotion of cooperation between the Republic of Serbia and Japan on the basis of equality, reciprocity and mutual benefit.
Article 2
JSEEBA will provide support in the activities related to the connecting with Japanese institutional partners in order to provide the implementation of different projects in the fields of agriculture, forestry and water management. In accordance with positive-legal regulations of the Republic of Serbia and needs expressed by the Ministry, JSEEBA will also provide the support in developing the institutional capacities of the Ministry.
Article 3
Both parties conclude that all necessary activities related to the connecting the Ministry with Japanese institutional partners will not arise any financial obligation to the Serbian Party unless otherwise agreed upon specific activities between the Parties.
JSEEBA reach a mutual agreement with the Ministry upon all the promotional activities, initiated by the Japanese Party, with the purpose to avoid any potential reputation damage for both Parties.
Article 4
The Ministry shall prepare appropriate requests in accordance with the technical standards for cooperating with Japanese institutions and other interested parties in the fields of agriculture, forestry and water management.
Ministry shall provide the information on needs for specific projects, study visit, exchange of information and the best practices.
Article 5
The Ministry shall consider the exchange of information and distribution to the Japanese Party in order to avoid any reputation damage for both Parties.
Article 6
Study visit specific projects and activities regarding the mutual cooperation, exchange of best practices, promotion of new technologies for agriculture, forestry and water management planned and implemented by both Parties, could be defined by annexes, additionally drafted and signed, according to the needs of the Ministry.
Article 7
JSEEBA shall conduct promotional activities in cooperation with the Ministry and relevant institutions and sponsors, in providing support to the JSEEBA’s activities.
Article 8
For the purpose of implementation of the specific projects, Parties shall periodically develop cooperation plans in which the particular types, content, methods and terms of cooperation will be specified for the certain period, as well as the financial plans for the implementation of appropriate activities related to this Agreement.
III CHANGES AND TERMINATION OF THE AGREEMENT
Article 9
This Agreement may be amended by mutual agreement, in writing.
Article 10
This Agreement shall enter into force with date of its signature. It shall be concluded for a period of twelve months and shall be automatically extended for a subsequent period of twelve months, unless one of the Parties informs the other in writing of the intention to terminate this Agreement at least three (3) months before the date of its termination.
IV TRANSITIONAL AND FINAL PROVISIONS
Article 11
JSEEBA local representative in the Republic of Serbia, company AQUAFARM SEE DOO, Reg. No.: 21125431, VAT no. (PIB): 109093549, will actively participate in planning, development and implementation of mutual projects and provide all necessary support to the Ministry in preparation of requests, communication and coordination with JSEEBA.
Article 12
Signed in Belgrade, on day February 2 2019, in two original copies, each in the Serbian and English languages, both texts equally authentic. In case of divergences of interpretation of the provisions of this Agreement, the English text shall prevail.
