MEMORANDUM
OF UNDERSTANDING FOR COOPERATION IN THE FIELD OF HIGHER EDUCATION BETWEEN THE MINISTRY OF EDUCATION, SCIENCE AND TECHNOLOGICAL DEVELOPMENT OF THE REPUBLIC OF SERBIA AND THE COUNCIL OF HIGHER EDUCATION OF THE REPUBLIC OF TURKEY

The Ministry of Education, Science and Technological Development of the Republic of Serbia and the Council of Higher Education of the Republic of Turkey (hereinafter referred to as the "Parties");

For the purpose of consolidating their cooperation in the field of higher education, in the spirit of enhancing mutual understanding and respect for the people of both countries and strengthening their bilateral relations;

Parties have agreed to the following:

Article 1

Aim

The present Memorandum of Understanding aims to establish the institutional framework for the Parties in order to organize academic and scientific exchanges between the higher education institutions of both countries.

Article 2

Areas of Cooperation

In order to achieve the goal stated in the Article 1, the Parties shall support educational and internship mobility of the students and academic staff at higher education institutions of two countries under specific programmes and their participation in short term research programmes, exchange of educational materials, organization of joint workshops, conferences and seminars, mutual university visits and other modalities that the Parties may agree upon.

Article 3

Joint Diplomas Programmes

The Parties shall encourage the establishment, implementation and development of joint diploma study programmes at bachelor, master and doctorate levels between the higher education institutions of both countries in accordance with their legislation.

Article 4

Scholarship Students

Within the framework of their legislation, the Parties may send and accept undergraduate and graduate students to study at their higher education institutions under modalities to be agreed upon by the Parties.

Article 5

Recognition

The Parties shall consult the relevant acts towards recognizing degrees and diplomas issued by recognized higher education institutions of both countries within the framework of their legislation and exchange necessary information on this subject.

Article 6

Limitations

The collaboration envisaged in this Memorandum of Understanding is limited to the national legislation. The Parties will be operating under their budgetary resources, unless agreed otherwise on specific projects.

Article 7

Employment relationship

Teaching staff engaged by each Party for the purpose of implementing the cooperation activities shall remain employed in their home institution, thus not creating any employment relationships with other institutions which shall not be regarded as substitute or joint employers.

Article 8

Intellectual property

Adequate and effective protection measures as well as fair distribution of intellectual property rights which may result from the research activities developed within the framework of this Memorandum of Understanding shall be ensured.

The protection of the intellectual property rights shall be enforced in accordance with the national legislations of Serbia and Turkey, and complying with the international agreements in force between both countries and those to which each country is signatory.

Article 9

Duration

The present Memorandum of Understanding shall become effective on the date on which is has been signed and shall be in force for a period of five (5) years, which shall be automatically renewed for the same period unless one of the Parties notifies their wish to terminate it in writing.

Article 10

Amendments

The present Memorandum of Understanding may be amended any time by mutual consent of the Parties.

Article 11

Termination

This Memorandum of Understanding may be terminated:

a. On the basis of mutual consent of the Parties, which should include an agreement on the date of the termination of the validity of the Memorandum of Understanding;

b. By cancellation of one of the Parties, by giving written notice, in which case the Memorandum of Understanding shall cease to apply after a period of sixty (60) days from the date of receipt of such notification by the other Party.

In the case of the present Memorandum of Understanding being terminated for any reason, the Parties commit themselves to finish the activities regarding students and academic staff who may be doing an academic stay on the termination date, until they have finished their respective study programmes.

Article 12

Settlement of Disputes

Any disputes arising from the interpretation, implementation, amendments and effects which may derive from the present Memorandum of Understanding shall be settled amicably by mutual consultation and dialogue between the Parties.

Done in ……………………. on …18.07.2019 in two (2) original copies in Serbian, Turkish and English languages, all being equally authentic. In case of any divergence in interpretation, the English text shall prevail.
