PROTOCOLOF PHYTOSANITARY REQUIREMENTS FOR THE EXPORT OF MAIZE FROM SERBIA TO CHINA BETWEEN THE MINISTRY OF AGRICULTURE, FORESTRY AND WATER MANAGEMENT OF THE REPUBLIC OF SERBIA AND THE GENERAL ADMINISTRATION OF CUSTOMS OF THE PEOPLE’S REPUBLIC OF CHINA("Off. Herald of RS - Treaties", No. 6/2021) |
In order to safely export maize from the Republic of Serbia (hereinafter referred to as Serbia) into the People’s Republic of China (hereinafter referred to as China) and to ensure the safety of agriculture and ecology in China, based on the results of the pest risk analysis (PRA), the Ministry of Agriculture, Forestry and Water Management of the Republic of Serbia (hereinafter referred to as MAFWM) and the General Administration of Customs of the People’s Republic of China (hereinafter referred to as GACC) have exchanged views and reached agreements on the phytosanitary requirements for Serbia origin maize as follows.
This protocol pertains only to phytosanitary requirements. Other Chinese standards and requirements regarding food safety, quality, also apply to Serbia maize, but are outside the scope of this protocol.
Article 1
The maize (Zea mays L.) in this Protocol referred to maize grain produced in Serbia and exported to China for processing and not for sowing.
Article 2
The maize exported to China shall comply with the requirements of China’s import phytosanitary laws, regulations and national standards of China and be free from live pests in particular the quarantine pests concerned by GACC (see Annex), soil, and be not intentionally added or mixed with other grains and impurities.
Article 3
MAFWM shall carry out investigation and test during the growing season of maize with international approved methods, and keep the monitoring record to minimize the pests’ occurrence, which are concerned by China. For each harvest season, MAFWM shall submit to GACC a report of surveillance of Maize dwarf mosaic virus, including the methods and the results, in the production areas during the current year, as well as other information requested by GACC.
MAFWM should supervise the enterprises that intent to export maize grains to China to establish integrated pest management system (IPM) measures to minimize the pest’ occurrence, which are concerned by China.
At the request of the GACC, MAFWM shall provide the above information to the GACC.
Article 4
MAFWM shall supervise the enterprises that export maize to China and shall determine they undertake effective measures such as sifting, cleaning, disinfecting in the process of maize harvesting, processing, storage and transportation, to reduce significantly plant debris, foreign matter, dangerous and noxious weed seeds. (Foreign matters shall be less than 1%; noxious weed seeds such as Datura sp. shall be less than 1 seed/kg according to China national standard: "Maize" and "Food Safety Standard for Grains".)
Article 5
MAFWM shall register storage enterprises for exporting maize to China in order to ensure that they meet the relevant anti-pest conditions, and submit the list of registered enterprises to GACC before exporting maize to China.
Article 6
MAFWM should implement plant quarantine for maize prior to export to China. For the consignment which meets the requirements specified in this Protocol, MAFWM shall issue a Phytosanitary Certificate including an additional declaration: "The consignment is in compliance with phytosanitary requirements described in the Protocol of maize from Serbia to China between the General Administration of Customs of the People’s Republic of China and the Ministry of Agriculture, Forestry and Water Management of the Republic of Serbia, and free from the quarantine pests concerned by China". For the consignments being found live insect, fumigation shall be carried out before export.
MAFWM shall provide a sample of the current valid phytosanitary certificates in advance to GACC so that the GACC member can verify the validity of the phytosanitary certificate when the consignment arrives at the entry port of China.
Article 7
The maize importers shall apply and acquire an Import Permit issued by Chinese customs before signing the trade contract. The maize exported to China shall entry at the Chinese designated ports and process at designated facilities; its handling, transportation, storage and processing shall comply with relevant Chinese phytosanitary requirements; it cannot enter the circulation market directly without those processing, and sowing is prohibited.
Article 8
When Serbia maize arrives at China’s entry port, the branches of GACC will implement inspection and quarantine.
If any quarantine pests in the Annex of this Protocol is found, the consignment will be allowed entry after effective treatment. In case of no effective treatment, the consignment shall be returned or destroyed. The relevant cost will be paid by exporter. In serious cases, GACC will suspend the import of maize from related the Serbia storage enterprises, related producing areas or even all producing area until the GACC confirms that MAFWM has taken effective improvement measures.
If other quarantine pests not categorized in Annex of this Protocol is identified, the consignment shall be treated in accordance with the relevant provisions of the Law of the People’s Republic of China on the Entry and Exit Animal and Plant Quarantine and its regulations for implementation.
Article 9
MAFWM shall promptly notify the GACC by writing reports of new pests occurred on maize in Serbia and its control measures taken.
GACC will develop further risk assessment and review this Protocol based on a situation of pest occurrence and interceptions from Serbia maize.
Article 10
Both sides agree to solve possible inspection and quarantine issues through technical consultation regarding Serbia maize imports to China. If necessary, GACC will send inspectors to Serbia, in cooperation with MAFWM, to review the pest control management, inspection and quarantine management etc. by MAFWM, the expensed related to the visit, including transportation, accommodation and living expensed, will be covered by export country side.
Article 11
This Protocol shall enter into force on the date of signature and remain valid for two years. This Protocol shall be automatically extended for another two years if no modification or termination is requested by either party before six months of the expiration.
This Protocol is signed in Belgrade on 04.02.2021, in two originals, each in Serbian, Chinese and English, and all texts are equally authentic. In case of any divergence of interpretation, the English text shall prevail.
