MEMORANDUM

OF UNDERSTANDING BETWEEN THE MINISTRY OF TRADE, TOURISM AND TELECOMMUNICATIONS OF THE REPUBLIC OF SERBIA AND THE MINISTRY OF DIGITAL GOVERNANCE OF THE HELLENIC REPUBLIC ON REDUCTION OF INTERNATIONAL ROAMING TARIFFS FOR TELECOMMUNICATION SERVICES

("Off. Herald of RS - Treaties", No. 12/2021)

The Ministry of Trade, Tourism and Telecommunications of the Republic of Serbia and the Ministry of Digital Governance of the Hellenic Republic, hereinafter jointly referred to as "the Parties",

Concerned by the current level of international roaming tariffs between the two countries,

Recognizing the high level of wholesale call termination rates resulting in high prices for mobile calls, SMS and data exchange in roaming between the two countries,

Wishing to reduce those tariffs for the benefit of the citizens of both countries,

Have reached the following understanding:

Article 1

The Parties shall encourage the Republic of Serbia and Hellenic Republic mobile operators (all the operators shall be referred to as "the Οperators") to reach specific agreements among themselves in order to achieve the goal of this MOU, namely the lasting reduction of the international wholesale tariffs ("the Τariffs").

Article 2

For the purpose of implementing Article 1 the Parties agree to cooperate in the framework of the International Telecommunication Union, as well as through bilateral contacts.

Article 3

The Parties believe that the wholesale reductions should be reflected (if technically possible) in retail roaming price cuts for the benefit of the citizens of both countries.

Article 4

The parties shall encourage the Operators, during their negotiations, to take into account the following:

• The current Tariffs between the Hellenic Republic and the Republic of Serbia mobile operators should be reduced.

• Operators will conduct bilateral negotiations, based on mutual confidentiality with the aim of concluding bilateral agreements on new reduced international wholesale roaming tariffs.

• The Operators, no later than within 6 months after the bilateral negotiations are concluded, will inform the Parties and their respective national regulatory authorities about the results.

Article 5

No Party shall transmit any commercially valuable confidential information obtained pursuant to this Memorandum to any third party without the prior written consent of the Party from which such information originated. A Party or Operator which discloses confidential information to the other Party or Operator shall ensure that such information is clearly marked as such.

Article 6

Any activities carried out by the Parties in pursuance of this Memorandum, shall be done in accordance with each Party’s competence, as well as in compliance with each Party’s applicable laws and regulations.

Article 7

The Ministry of Digital Governance of the Hellenic Republic shall apply this Memorandum respecting the obligations arising from the membership of the Hellenic Republic to European Union.

Article 8

Any disputes regarding the interpretation or implementation of this Memorandum shall be settled through consultations and negotiations between the Parties.

Article 9

This MoU may be amended at any time in writing, by mutual consent of the Parties. Any such amendment shall enter into force in accordance with the procedure described in Article 10 and shall thereafter become an integral part of this Memorandum.

Article 10

This MoU shall enter into force on the day of receipt of the second notification, by which the Parties notify each other through diplomatic channels about the completion of their respective national procedures for the entry into force of the Memorandum. It shall remain into force until either of the Parties notifies the other in writing, through diplomatic channels aboutits intention to terminate it, at least six months prior to the intended date of termination.

Signed in Athens on 21th of May in two originals each in the Serbian, Greek and English languages, all texts being equally authentic. In case of any divergence the English text shall prevail.
