LAWON THE SEATS AND TERRITORIAL JURISDICTIONS OF COURTS AND PUBLIC PROSECUTORS’ OFFICES("Off. Herald of RS", No. 101/2013) |
Article 1
This Law shall establish misdemeanour, basic, higher, commercial and appellate courts, identify the seats and territorial jurisdictions thereof and designate departments of the Misdemeanour Appellate Court and the Administrative Court and territorial jurisdictions thereof.
This Law shall also establish basic, higher and appellate public prosecutors’ offices and identify the seats and territorial jurisdictions thereof.
Article 2
The misdemeanour courts shall be the following:
1) The Misdemeanour Court in Aranđelovac for the territory of the municipalities of Aranđelovac and Topola, with the court department in Topola,
2) The Misdemeanour Court in Bačka Palanka, for the territory of the municipalities of Bač, Bačka Palanka and Bački Petrovac, with the court departments in Bač and Bački Petrovac,
3) The Misdemeanour Court in Belgrade, for the territory of the urban municipalities of Barajevo, Voždovac, Vračar, Grocka, Zvezdara, Zemun, Novi Beograd, Palilula, Rakovica, Savski Venac, Stari Grad, Surčin and Čukarica, with the court departments in Barajevo and Grocka,
4) The Misdemeanour Court in Bečej, for the territory of the municipalities of Bečej, Žabalj, Srbobran and Temerin, with the court departments in Žabalj, Srbobran and Temerin,
5) The Misdemeanour Court in Valjevo, for the territory of the municipalities of Lajkovac, Ljig, Mionica, Osečina and Ub, and the city of Valjevo, with the court departments in Lajkovac, Ljig, Mionica, Osečina and Ub,
6) The Misdemeanour Court in Vranje, for the territory of the municipalities of Bosilegrad, Bujanovac, Vladičin Han, Surdulica and Trgovište, and the city of Vranje, with the court departments in Bujanovac, Vladičin Han and Surdulica,
7) The Misdemeanour Court in Vršac, for the territory of the municipalities of Bela Crkva, Vršac and Plandište, with the court departments in Bela Crkva and Plandište,

The basic courts shall be the following:

The Higher Court in Belgrade shall be competent to decide in the first instance on ban on press distribution and dissemination of information by the media and to adjudicate in disputes on publishing correction to information and response to information, to decide on violation of prohibition of hate speech, protection of the right to private life, i.e. right to personal recording, failure to publish information and damages in connection with publication of information in the territory of the Republic of Serbia.
The Higher Court in Belgrade shall also be competent for disputes concerning copyright and related rights and protection and use of inventions, industrial design, models, samples, trademarks, geographical indications, topography of integrated circuits, i.e. topography of semiconductor products and plant breeders for the territory of the Republic of Serbia.
Article 5
The commercial courts shall be the following:

15) The Commercial Court in Užice, for the territory of the municipalities of Arilje, Bajina Bašta, Kosjerić, Nova Varoš, Požega, Priboj, Prijepolje and Čajetina, and the city of Užice,
16) The Commercial Court in Čačak, for the territory of the municipalities of Gornji Milanovac, Ivanjica and Lučani, and the city of Čačak.
The Commercial Court in Belgrade shall be competent for disputes concerning copyright and related rights and protection and use of inventions, industrial design, models, samples, trademarks, geographical indications, topography of integrated circuits, i.e. topography of semiconductor products and plant breeders for the territory of the Republic of Serbia.
Article 6
The appellate courts shall be the following:
1) The Appellate Court in Belgrade, for the territories of the higher courts in Belgrade, Valjevo, Pančevo and Smederevo,
2) The Appellate Court in Kragujevac, for the territories of the higher courts in Jagodina, Kragujevac, Kruševac, Kraljevo, Novi Pazar, Požarevac, Čačak and Užice,
3) The Appellate Court in Niš, for the territories of the higher courts in Vranje, Zaječar, Negotin, Leskovac, Niš, Prokuplje and Pirot,
4) The Appellate Court in Novi Sad, for the territories of the higher courts in Zrenjanin, Novi Sad, Sombor, Sremska Mitrovica, Subotica and Šabac.
6. Departments of the Misdemeanour Appellate Court
Article 7
Departments of the Misdemeanour Appellate Court shall be the following:
1) The Department in Kragujevac, for the territories of the misdemeanour courts in Aranđelovac, Gornji Milanovac, Jagodina, Kragujevac, Kraljevo, Kruševac, Novi Pazar, Paraćin, Požega, Prijepolje, Raška, Sjenica, Trstenik, Čačak and Užice,

Article 11

4) The Appellate Public Prosecutor's Office in Novi Sad, for the territory of the Appellate Court in Novi Sad.
IV COURTS AND PUBLIC PROSECUTORS’ OFFICES IN THE TERRITORY OF THE AUTONOMOUS PROVINCE OF KOSOVO AND METOHIJA
Article 12
Establishment of courts and public prosecutors’ offices competent for the Autonomous Province of Kosovo and Metohija, their seats and territorial jurisdictions thereof shall be governed by a separate law.
V TRANSITIONAL AND FINAL PROVISIONS
Article 13
Courts and public prosecutors’ offices, established by the Law on the Seats and Territorial Jurisdictions of Courts and Public Prosecutors’ Offices (“Official Herald of RS”, No. 116/08), shall continue their operations up to the day this Law becomes applicable.
The cases wherein, until the day this Law begins to apply, no decision is rendered by the courts and public prosecutors’ offices established by the Law on the Seats and Territorial Jurisdictions of Courts and Public Prosecutors’ Offices (“Official Herald of RS”, No. 116/08), shall be taken over by the territorially competent courts and public prosecutors’ offices established by this Law.
Notwithstanding paragraph 2 of this Article, the cases received in the appellate courts until the day this Law begins to apply, shall be decided on by the appellate courts that are competent in accordance with the Law on the Seats and Territorial Jurisdictions of Courts and Public Prosecutors’ Offices (“Official Herald of RS”, No. 116/08).
In the court units of basic courts determined by the Law on the Seats and Territorial Jurisdictions of Courts and Public Prosecutors’ Offices (“Official Herald of RS”, No. 116/08), and which according to the provisions of this Law cease to operate, the reception offices shall continue to operate wherein receipt of writs and verification of documents and signatures shall be carried out.
The operations at the reception offices referred to in paragraph 4 of this Law shall be carried out until the public notaries begin to operate.
Article 14
Until the day this Law begins to apply, the High Judicial Council shall, in accordance with the provisions of the Law on Judges, carry out transfer of judges and lay judges to the courts established by this Law, and which had not been established by the Law on the Seats and Territorial Jurisdictions of Courts and Public Prosecutors’ Offices (“Official Herald of RS”, No. 116/08).
Until the day this Law begins to apply, the High Judicial Council shall, in accordance with the provisions of the Law on Judges, carry out transfer of judges and lay judges to the courts established by this Law, territorial jurisdictions of which have been changed under this Law in relation to the Law on the Seats and Territorial Jurisdictions of Courts and Public Prosecutors’ Offices (“Official Herald of RS”, No. 116/08).
Until the day this Law begins to apply, the High Judicial Council shall appoint acting presidents of the courts in the courts established by this Law, which have not been established by the Law on the Seats and Territorial Jurisdictions of Courts and Public Prosecutors’ Offices (“Official Herald of RS”, No. 116/08).
Until the day this Law begins to apply, the High Judicial Council shall appoint acting presidents of the courts in the courts established by this Law, territorial jurisdictions of which have been changed under this Law in relation to the Law on the Seats and Territorial Jurisdictions of Courts and Public Prosecutors’ Offices (“Official Herald of RS”, No. 116/08), except for the courts wherein election of the presidents of the courts has been carried out in accordance with the Law on Judges.
On the day this Law begins to apply, office of the president of court in the courts established by this Law, territorial jurisdictions of which have been changed under this Law in relation to the Law on the Seats and Territorial Jurisdictions of Courts and Public Prosecutors’ Offices (“Official Herald of RS”, No. 116/08), shall be terminated.
Performing function of the president of the courts referred to in paragraphs 3 and 4 of this Article shall last until election of the presidents of courts in accordance with the provisions of the Law on Judges.
Article 15
Until the day this Law begins to apply, transfer of the deputy public prosecutors from the abolished public prosecutors’ offices shall be carried out, in accordance with the Law on Public Prosecution.
Until the day this Law begins to apply, acting public prosecutors in the public prosecutors’ offices established by this Law which had not been established by the Law on the Seats and Territorial Jurisdictions of Courts and Public Prosecutors’ Offices (“Official Herald of RS”, No. 116/08), shall be appointed, in accordance with the Law on Public Prosecution.
Until the day this Law begins to apply, acting public prosecutors in the public prosecutors’ offices established by this Law, which assume jurisdiction of the abolished public prosecutors’ offices, shall be appointed, in accordance with the Law on Public Prosecution.
Public prosecutors whose office has been terminated due to abolishment of the public prosecutor's office shall continue to perform function of the deputy public prosecutor in accordance with the Law on Public Prosecution.
Performing function of the public prosecutor referred to in paragraphs 2 and 3 of this Article shall last until election of the public prosecutors, in accordance with the Law on Public Prosecution.
Article 16
Courts and public prosecutors’ offices established by this Law shall take over the required tools, equipment, archives and staff of the courts and public prosecutors’ offices established by the Law on the Seats and Territorial Jurisdictions of Courts and Public Prosecutors’ (“Official Herald of RS”, No. 116/08).
The minister competent for justice shall establish a commission, which shall, until the day this Law begins to apply, perform distribution of tools, equipment and archives referred to in paragraph 1 of this Article.
The High Judicial Council and the State Prosecutorial Council shall establish commissions to pass decisions on assigning the courts and public prosecutors’ offices staff referred to in paragraph 1 of this Article, in accordance with the interim act on internal organisation and job classification to be issued by the minister competent for justice by 1 December 2013.
Article 17
Until adoption of the separate law referred to in Article 12 of this Law, the courts and public prosecutors’ offices referred to in Article 2, item 13), Article 3, item 11), Article 4, item 7), Article 9, item 11) and Article 10, item 7) of the Law on the Seats and Territorial Jurisdictions of Courts and Public Prosecutor's Offices (“Official Herald of RS”, No. 116/08) shall continue to operate.
Until adoption of the separate law referred to in Article 12 of this Law, the courts and public prosecutors’ offices referred to in Article 5, item 8), Article 6, item 3), Article 7, item 2), Article 8, item 2) and Article 11, item 3) of this Law shall continue to exercise statutory jurisdictions for the territory of the Autonomous Province of Kosovo and Metohija.
The separate law referred to in Article 12 of this Law shall be adopted until 31 December 2013.
Article 18
On the day this Law begins to apply, the Law on the Seats and Territorial Jurisdictions of Courts and Public Prosecutors’ Offices (“Official Herald of RS”, No. 116/08) shall cease to be valid, except for the provisions of that law specified in Article 17, paragraph 1 of this Law.
Article 19
This Law shall enter into force on the day following the day of its publication in the “Official Herald of the Republic of Serbia”, and shall apply as of 1 January 2014.
