MEMORANDUM
OF UNDERSTANDING BETWEEN THE MINISTRY OF AGRICULTURE, FORESTRY AND WATER MANAGEMENT OF THE REPUBLIC OF SERBIA AND THE MINISTRY OF AGRICULTURE AND AGRARIAN REFORM OF THE SYRIAN ARAB REPUBLIC ON COOPERATION IN THE FIELD OF AGRICULTURE

The Ministry of Agriculture, Forestry and Water Management of the Republic of Serbia and The Ministry of Agriculture and Agrarian Reform of the Syrian Arab Republic, hereinafter referred to as "the Parties".

Desiring to foster friendly relations and enhance cooperation in the field of agriculture between two countries;

In accordance with the principles of equality, mutual respect and reciprocal benefit,

Declaring the intention to intensify cooperation between the Parties,

Aiming to expand mutual cooperation in the filed of agriculture,

Have agreed as follows:

ARTICLE 1

This Memorandum of Understanding aims to promote cooperation between both Parties in the field of agriculture in accordance with their competences, taking into consideration the mutual priorities and interests of both Parties. The Parties shall, within the scope of their competences and in the framework of their national legislation and other international treaties to which they are signatories, facilitate the establishment of relations between all entities worked in agricultural sector of both countries.

ARTICLE 2

In order to achieve the aim of this Memorandum of Understanding, the Parties shall support and promote concrete cooperation in the following fields:

1. Exchange of scientific and technical information and scientific research findings, as well as implementation of joint research programmes in the field of agriculture;

2. Development and introduction of technologies in the field of agriculture;

3. Post-harvest technologies, agro processing and marketing with backward and forward linkages;

4. Promotion of joint programmes in the field of agriculture;

5. Promotion of business to business cooperation in the field of agriculture and allied sectors;

6. Cooperation in veterinary and phyto-sanitary fields related to animal health, welfare and breeding, as well as plant health and plant protection, including seed and other planting materials;

7. Cooperation in areas of biotechnology, organic agriculture, aquaculture and development of quality policy in the agriculture.

ARTICLE 3

The fields of cooperation referred to in Article 2 of this Memorandum of Understanding shall be achieved through:

1. Mutual visits of representatives of scientific and research institutions;

2. Organizing training courses, and technical programs, symposia, seminars, conferences, exhibitions and fairs devoted to various fields of agriculture;

3. Development and implementation of mutually beneficial projects, dealing with key issues and priorities in the agrarian sector;

4. Mutual visits of representatives engaged in agricultural production and processing industry.

ARTICLE 4

The implementation of this Memorandum of Understanding shall be without prejudice to the fulfilment of obligation of the Parties arising from bilateral and multilateral international agreements to which either of them is a State signatory and stemming from their respective membership in international and regional organizations. The Parties shall apply standards, rules, regulations and procedures of international organizations of which they are members.

ARTICLE 5

The information and documents exchanged under this Memorandum of Understanding, shall be used by both Parties, except for the purpose specified therein, and no information or documents exchanged between them shall be transferred to a third party without the prior written approval by the party providing such information and documents.

ARTICLE 6

1. Each Party shall designate its representatives to coordinate with the other Party in order to follow up the implementation of the activities and projects of joint interest that are agreed upon by the Parties, in accordance with this Memorandum of Understanding. The costs of organizing meetings, are to be borne by the Party of host. Each Party shall bear the costs of it own delegation.

2. The Parties shall arrange, if necessary, joint meetings, the location, terms and agenda of such meetings are to be determined by the competent authorities of the hosting Party.

ARTICLE 7

Each Party shall bear its own costs related to the implementation of the items of this Memorandum of Understanding, taking into consideration their available resources, unleless otherwise agreed upon.

ARTICLE 8

Any disputes arising from the interpretation and/or implementation of this Memorandum of Understanding will be settled by the Parties through mutual consultations and negotiations or through diplomatic channels.

ARTICLE 9

1. This Memorandum of Understanding shall enter into force upon signature.

2. This Memorandum of Understanding shall be valid for period of (5) five years, and shall be renewed automatically for similar period, unless one of the Parties notifies the other in writing through diplomatic channels, of its intention to terminate it at least (6) six months prior to the date of termination.

The termination of this Memorandum of Understanding shall not affect the ongoing activities and projects until completion, unless the Parties agree otherwise.

3. Either party may amend, change or add any item or article of this Memorandum of Understanding by mutual written consent through diplomatic channels, in the form of separate Protocols, such amendments, changes and additions will enter into force according to item /1/ of this Article and they will be considered as an integral part of this Memorandum of Understanding.

Done and signed in ………………………… on ……………….., in two original copes, each in Serbian, Arabic and English languages, all text being equally authentic. In case of divergence in interpretation, the English text shall prevail.
