PROTOCOLBETWEEN THE MINISTRY OF AGRICULTURE, FORESTRY AND WATER MANAGEMENT OF THE REPUBLIC OF SERBIA AND THE GENERAL ADMINISTRATION OF CUSTOMS OF THE PEOPLE›S REPUBLIC OF CHINA ON QUARANTINE AND HYGIENE REQUIREMENTS FOR PET FOOD TO BE EXPORTED FROM SERBIA TO CHINA("Off. Herald of RS - Treaties", No. 5/2023) |
Ministry of Agriculture, Forestry and Water Management of the Republic of Serbia (hereinafter referred to as "the Serbian side") and the General Administration of Customs of the People›s Republic of China (hereinafter referred to as "the Chinese Side", together as "the Sides"), after friendly negotiations, have reached the following agreement on quarantine and hygiene requirements regarding for pet food to be exported from Serbia to China:
Article 1
Manufacturers exporting pet food to China will implement a health management system according to HACCP principles, and will be approved and supervised by the Serbian competent authority. Their products will comply with the relevant laws and regulations in Serbia, and will be allowed for free sale in the Serbian domestic market.
Article 2
Manufacturers exporting pet food to China will be approved by the Serbian side and recommended to the Chinese Side. After they have been registered by the Chinese Side, they are authorized to export pet food to China.
Article 3
Manufacturers exporting pet food to China will conform to the List of animals and their products prohibited from importing from countries and regions where animal epidemics are prevalent except the avian-origin canned pet food which were subjected to a heat treatment to a minimum FO value of 3 and comply with the commercial sterilization requirement.
Article 4
The Serbian side will ensure that the raw material used to produce pet food to China meets the following requirements:
1. The raw materials of terrestrial animal-origin for the pet food originated from native animals, slaughtered in the officially approved slaughterhouse, which underwent ante- and post-mortem inspection and didnt show any clinical signs of infectious diseases. No dead animals or animals slaughtered for disease eradication were used as raw materials. If the raw materials come from another country, they must be produced in a country which has been approved and released by the Chinese side.
2. The raw materials of terrestrial animal-origin originate from the areas which are free from Bovine Spongiform Encephalopathy, Foot and Mouth Disease, Classical Swine Fever, African Swine Fever, Swine Vesicular Disease, Highly Pathogenic Avian Influenza, Newcastle Disease, and which are approved by the Chinese side and comply with the WOAH (World Organisation for Animal Health) regulations.
3. The fish-origin raw materials for the pet food are derived from fish or other aquatic animals, except sea mammals, and the by-products other than intestines and gills from the plant manufacturing fish products for human consumption.
4. The plant-origin raw materials for pet food do not contain any toxic or hazardous substances to animal health or prohibited ingredients including genetically modified ingredients which have not been approved by the Chinese authorities.
Article 5
1. The control of the production process will meet the following requirements:
Canned pet food were subjected to a heat treatment to a minimum FO value of 3.
1.2 Processed pet food other than canned pet food were subjected to a heat
treaünent at no less than 90oC, or to another equivalent treatment approved by the Serbian side and recognized by the Chinese Side.
2. Prior to export, at least 5 samples for each production batch were tested and are in, compliance with the following requirements:
2.1 Canned pet food will be in compliance with the commercial sterilization requirement,
2.2 Processed pet food other than canned pet food will be in compliance with:
Salmonella: none in 25g of product: n=5, c=0, m=0, M=O;
Enterobacteriaceae: in lg of sample, n=5, C=2, m = 10CFU/g, M = 300CFU/g;
Where:
n = number of samples to be tested; m = threshold value of the number of bacteria; the result is considered satisfactory if the number of bacteria in all samples does not exceed m;
M maximum value for the number of bacteria; the result is considered unsatisfactory if the number of bacteria in one or more samples is M or more; and c = number of samples the bacterial count of which may be between m and M, the sample still being considered acceptable if the bacterial count of the other sample is m or less.
3. Effective measures will be taken to avoid contamination during processing, storaging and transportation.
Article 6
The product will not carry any prohibited articles as stipulated by Chinese laws and regulations, not contain any toxic or hazardous substance harmful to animal health, and meet the related safety and hygiene legislation of both Sides.
Article 7
Every batch of products exported to China will be packaged in new, clean, well-sealed, moisture resistant and not easily broken materials.
Products will be labelled in Chinese. And the product labelling will comply with the requirements of "Pet Food Label Rules". The product package will be marked with the name and registration number of the facility, and Chinese characters such as "to the People›s Republic of China" and "not for human consumption " or "for pet food only"
Article 8
The Serbian side will be responsible for the inspection of pet food exported to China and the issuance of health certificates, certiffing that the products meet the requirements of this Protocol. Each batch of pet food exported to China will be accompanied with a health certificate (one original and two duplicates) in English, Serbian and Chinese version.
Article 9
1. After the certificate sample is confirmed by both Sides, the Serbian side will provide the Chinese Side with ten (10) copies of the certificate with valid stamp ofthe competent authorities of Serbia.
2. In the event the Serbian side wants to change the certificate, it will inform the Chinese Side at least a month in advance and provide ten (10) copies of the certificate.
Article 10
The Serbian side will apply for an extension six months before the expiry of registration validity of the factories.
Article 11
Under the requirements, the Chinese side may send experts to Serbia once every five years to carry out retrospective review of the official regulatory system of the pet food exported to China, and to carry out comprehensive check of the implementation of the Protocol. If there are major safety and health problems during the period, the Chinese side may conduct inspections at any time.
Article 12
This Protocol will come into effect on the date of its signing and will apply for a period of five (5) years. Upon agreement of both Sides, this Protocol can be amended. On expiry of this period, the period of validity will be automatically extended for a further five (5) years if none of the Sides wishes to amend or terminate it. In the event one Side wishes to terminate this Protocol, it will inform the other Side in writing six (6) months in advance.
Article 13
This Protocol is signed i ______________ on ________________ done in two copies, both in Serbian, Chinese and English, these three languages being equally authentic. If there is any difference, the English version should be prevailing.
