MEMORANDUMOF UNDERSTANDING BETWEEN THE MINISTRY OF AGRICULTURE, FORESTRY AND WATER MANAGEMENT OF THE REPUBLIC OF SERBIA AND THE MINISTRY OF WATER RESOURCES AND IRRIGATION OF THE ARAB REPUBLIC OF EGYPT IN THE FIELD OF WATER REESOURCES AND IRRIGATION("Off. Herald of RS - Treaties", No. 1/2025) |
Preamble
The Ministry of Agriculture, Forestry and Water Management of the Republic of Serbia and the Ministry of Water Resources and Irrigation of the Arab Republic of Egypt (hereinafter referred to as "The Parties").
Desiring to promote cooperation between the two countries in the field of water resources on the basis of equality, mutual benefit and mutual respect noted that issues related to utilization and management of water resources are equally important for both countries,
Have reached the following understanding;
Article (1)
The Parties, within the framework of this Memorandum of Understanding) hereinafter referred to as "MOU"), and the laws, statutes, rules, regulations and national policies in force in each country, agree to extend cooperation in the field of utilization and management of water resources on the basis of the principles of equal rights and mutual benefit.
Article (2)
The Parties shall cooperate in the following directions:
1. Exchange of experience in the field of rational use and trans-boundary management of water resources;
2. Exchange of experience in the field of implementation of modern methods and techniques used to improve water quality.
3. Exchange of experience in the field of adaption to the climate change;
4. Organization of trainings, courses, conferences and workshops for the purpose of sharing know-in the field of irrigation and aquaculture.
5. Cooperation in other areas of common interest to be agreed mutually.
Article (3)
The Parties agree that, the Ministry of Agriculture, Forestry and Water Management of the Republic of Serbia and the Ministry of Water Resources and Irrigation of Arab Republic of Egypt, set up "the Working Group" (hereinafter referred as "the Working Group"), which will be responsible for the implementation of the MOU and organizing bilateral cooperation. The Working Group meetings shall be held according to mutual demands alternatively in the Republic of Serbia and in the Arab Republic of Egypt.
Article (4)
Each Party shall finance the costs of international travel, accommodation, food and costs as incurred by its own visiting delegations. Host country shall bear the costs of organization of the meetings.
Article (5)
Confidentiality and the Respect of Intellectual Property
During the period of activities and after termination of this MOU or any other protocol concluded pursuant to this MOU, Parties shall adhere to the confidentiality and secrecy of documents, information and other data received from other party or supplied to the other party, and abide by the laws, rules and regulations related to the intellectual property, which are in force in the countries of both Parties as well as other international agreements binding on either Party.
Article (6)
1. Each Party can make amendments to this MOU by mutual consent through separate protocols, which will be considered as its integral parts.
2. Any amendment shall not affect the rights and obligations from the ongoing activities of cooperation until their completion.
3. Such amendments shall come into force only after following the same procedure set out for the entry into force of this MOU.
Article (7)
Any difference or dispute arising from the application or interpretation of the provisions of this MOU shall be settled amicably through consultations and negotiations between the two Parties through diplomatic channels and without resorting to a national or international court or third party for the purpose of settlement.
This MOU does not create any legal or financial obligations under domestic or international law on the Parties.
Article (8)
Entry into Force, Duration, Termination and Extension
1. This MOU shall come into force on the date of signing and shall remain in force for a period of five (5) years. It will be automatically extended for further consecutive periods of five (5) years, unless terminated by either Party by a written notice through diplomatic channels to the other Party at least six (6) months prior to the date of expiration.
2. The termination of this MOU shall not affect the implementation of ongoing activities/programs which have been agreed upon prior to the date of the termination of this MOU.
Done in…..., on …...in two originals copies each in Serbian, Arabic and English languages, and all texts are being equally authentic. In case of divergence interpretation, the English text shall prevail.
