AGREEMENT
BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SERBIA AND THE GOVERNMENT OF NEPAL ON THE EXEMPTION FROM VISA REQUIREMENTS FOR HOLDERS OF DIPLOMATIC AND OFFICIAL PASSPORTS

The Government of the Republic of Serbia and the Government of Nepal (hereinafter referred to individually as "Party" and collectively as the "Parties"),

Desirous of promoting their bilateral relations and aiming to facilitate travel of their respective nationals, holders of diplomatic and official passports,

Have reached the following understanding:

Article 1

Nationals of either Party, holding a valid diplomatic or official passport, shall be allowed to enter, transit through and stay in the territory of the other Party without a visa for a period not exceeding 30 (thirty) days during a period of 90 (ninety) days following the date of first entry.

Article 2

Nationals of either Party, holding a valid diplomatic or official passport, members of the staff of a diplomatic or consular mission located in the territory of the other Party, and their dependents, holding a valid diplomatic or official passport, may enter and reside without a visa, if their first entry is notified through diplomatic channels 30 (thirty) days prior to it.

Nationals of either Party, holding a valid diplomatic or official passport, representing their country in an international organization located in the territory of the other Party, and their dependents, holding a valid diplomatic or official passport, shall be entitled to the same rights referred to in paragraph 1 of the present Article.

Article 3

Nationals of either Party, holding a valid diplomatic or official passport, shall cross the border only at the border crossing points intended for international travel.

Article 4

Nationals of either Party, holding a valid diplomatic or official passport, shall be obliged to abide by the laws and regulations of the other Party, during their stay in the territory of that Party.

Article 5

This Agreement shall not restrict the right of the competent authorities of either Party to refuse admission of entry, shorten or terminate the stay of the national of the other Party, holding a valid diplomatic or official passport, without giving the reasons for their decision, provided that he/she is considered persona non grata.

Article 6

The Parties shall exchange, through diplomatic channels, specimens of their valid diplomatic and official passports and all information concerning their use.

If new passports are introduced, or if the current ones undergo modifications, either Party shall immediately inform the other Party and exchange their specimens through diplomatic channels, prior to their formal introduction.

Article 7

Any disputes that might arise out of the interpretation or implementation of this Agreement shall be settled through diplomatic channels.

Article 8

Either Party may suspend, on a temporary basis, in part or in whole, the implementation of this Agreement for reasons of national security, public order or public health. Such a suspension shall become effective immediately after the other Party receives notice thereon through diplomatic channels. Either Party shall apply the same procedure if the suspension is lifted.

Article 9

Either Party may request in writing, through diplomatic channels, amendments to the present Agreement. Any amendment agreed upon by the Parties shall enterinto force as described in Article 10 of this Agreement.

Article 10

This Agreement shall enter into force 30 (thirty) days after the date of the receipt of the last notification in writing, through diplomatic channels, that the requirements envisaged by their national legislation for its entry into force have been met. It shall remain valid for a period of five years, thereafter its validity shall be extended for consecutive periods of two years, unless terminated.

Either Party may terminate this Agreement at any time by informing the other Party through diplomatic channels. The validity of the present Agreement shall cease after 90 (ninety) days from the date on which such notice has been received.
