MEMORANDUMOF UNDERSTANDING BETWEEN THE MINISTRY OF INTERNAL AND FOREIGN TRADE OF THE REPUBLIC OF SERBIA AND THE MINISTRY OF COMMERCE OF THE PEOPLE’S REPUBLIC OF CHINA ON COOPERATION ON ELECTRONIC COMMERCE("Off. Herald of RS - Treaties", No. 10/2025) |
The Ministry of Internal and Foreign Trade of the Republic of Serbia and the Ministry of Commerce of the People’s Republic of China (hereinafter referred to as "the Parties"):
Considering that:
Serbia and China enjoy a Comprehensive Strategic Partnership;
The potential of electronic commerce for the Serbian and Chinese Enterprises, particularly Small and Medium Enterprises;
Strengthening cooperation on electronic commerce will improve trade and cooperation between Serbia and China, and will promote a sustainable development of bilateral trade.
Have reached the following understanding:
1. The Parties will cooperate on a reciprocal basis to promote a favourable environment for electronic commerce, they will hold regular dialogues to enable exchange of informationon electronic commerce matters. The Parties will cooperate by the following means:
a. exchange of experiences on regulations and policy making;
b. exchange of information;
c. promotion of regional cooperation and public-private dialogue, also considering the projects currently in progress;
d. development of joint studies and personnel training, particularly for the benefit of SMEs.
2. The Parties will encourage business-to-business and business-to-consumer cooperation on electronic commerce in Serbia and China, in this regard, the Parties will:
a. encourage enterprise cooperation on E-commerce in Serbia and China;
b. facilitate the cooperation between Small and Medium Enterprises and large electronic commerce platforms.
3. The activities foreseen under this Memorandum of Understanding will be implemented by the Parties according to their ordinary budget availability without any additional cost for the State budgets of the Republic of Serbia and the People’s Republic of China.
4. This Memorandum of Understanding will be implemented in accordance with the Serbian and Chinese legislations, as well as applicable international law. This Memorandum of Understanding does not constitute an international agreement which may lead to obligations under international law. No provision of this Memorandum of Understanding is to be understood and performed as a legal obligation or commitment of the Parties.
5. This Memorandum of Understanding takes effect on the date of signature and will be valid for a period of three (3) years. This Memorandum of Understanding will be automatically extended for further periods of three years unless one of the Parties notifies the other of its intention to terminate it by giving a six months’ prior notice.
6. The Parties may amend this Memorandum of Understanding in writing by mutual consent.
7. Any difference in the interpretation and/or implementation of this Memorandum of Understanding will be settled amicably by means of direct consultations and negotiations between the Parties.
Done at Belgrade on 8 May 2024, in two originals, each in the Serbian, Chinese and English languages, all texts being equally authentic. In case of divergence of interpretation, the text in English will prevail.
